WildLens Terms of Service

Effective Date: January 9, 2026 Last Updated: January 9, 2026

These Terms of Service (“Terms”) are a legal agreement between you (“you” or “User”) and ThinkCreative Media Ltd (“WildLens,” “we,” “us,” or “our”) governing your access to and use of the WildLens mobile application and related services (collectively, the “Service”).

By downloading, installing, accessing, or using WildLens, you agree to be bound by these Terms and our Privacy Policy (incorporated by reference). If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to create your own WildLens account. If you are under the age of majority in your jurisdiction, you may use the Service only with the involvement and consent of a parent or guardian, who agrees to these Terms on your behalf and is responsible for your use of the Service, including any purchases made through your account. The App’s “Beginner” and “Expert” chat modes are content-depth settings available to all eligible users and are not age-restricted or child-specific features.

By using the Service, you represent that you meet these requirements.

2. Account Registration

3. The Service

WildLens allows users to:

AI-Generated Content. Species identifications, symptom/health guidance, and chat responses are generated using artificial intelligence (including Google’s Gemini API) and automated models. This content is provided for general informational and educational purposes only. AI outputs can be incomplete, outdated, or incorrect.

No Professional Advice. WildLens is not a substitute for the judgment of a licensed veterinarian, physician, wildlife biologist, or other qualified professional. Do not rely on the App for:

You use all identification results, safety guidance, and symptom/health content at your own risk.

4. Subscriptions, Credits, and Payments

4.1 Tiers

WildLens offers a Free tier, a Credits tier (pay-as-you-go credit packs), and a Pro subscription tier, each with different feature access and usage limits, as described in the App.

4.2 Billing

4.3 Refunds

Refund requests are handled in accordance with Google Play’s refund policies. We do not directly process refunds outside of the Google Play platform except as required by law.

4.4 Credits

In-app credits are a limited, non-transferable license to access certain features and have no cash value. Credits may be earned (e.g., via daily allotments or rewarded ads) or purchased. Credits are consumed only upon successful completion of the associated action (e.g., a completed identification scan); we do not charge credits for scans that fail or are abandoned due to a technical error on our end.

4.5 Price Changes

We may change subscription or credit-pack pricing at any time. Any change will apply prospectively and, for subscriptions, will be communicated in advance as required by Google Play policy and applicable law.

5. Acceptable Use

You agree not to:

We reserve the right to suspend or terminate your access for violation of this Section.

6. Referral Program

The referral program allows users to earn credits by referring new users, subject to program rules (including per-account referral caps) displayed in the App. We reserve the right to modify, limit, or discontinue the referral program at any time, and to deny or reverse credits obtained through fraudulent, abusive, or self-referral activity.

7. User Content

“User Content” means photos, chat messages, and any other content you submit through the App.

8. Intellectual Property

The App, including its design, branding, species encyclopedia content, software, and underlying technology (excluding User Content and third-party content), is owned by ThinkCreative Media Ltd or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use in accordance with these Terms. All rights not expressly granted are reserved.

9. Third-Party Services

The Service relies on and integrates with third-party services, including Google (Gemini API, Sign-In, Play Billing, AdMob, Firebase Cloud Messaging) and Supabase. Your use of the Service may also be subject to those providers’ own terms. We are not responsible for outages, errors, or changes originating from third-party services outside our control.

10. Advertising

Free-tier and Credit-tier use of the App may include advertising served through Google AdMob. See our Privacy Policy for details on advertising data practices and your consent choices.

11. Disclaimers

THE SERVICE, INCLUDING ALL SPECIES IDENTIFICATIONS, SYMPTOM/HEALTH GUIDANCE, AND CHAT CONTENT, IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR RELIABILITY.

We do not warrant that:

Wildlife interaction carries inherent risk. You acknowledge that approaching, photographing, or interacting with wild animals can be dangerous, and that WildLens’s safety content (e.g., the “Danger” tab) is general guidance only and not a substitute for your own judgment, local laws, or expert advice.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ThinkCreative Media Ltd AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, INCLUDING ANY RELIANCE ON AI-GENERATED IDENTIFICATIONS OR HEALTH/SAFETY GUIDANCE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) [INSERT NOMINAL AMOUNT, e.g., USD $50].

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless ThinkCreative Media Ltd from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms, your User Content, or your misuse of the Service.

14. Termination

15. Changes to the Service and These Terms

We may modify, suspend, or discontinue any part of the Service at any time. We may update these Terms from time to time; material changes will be communicated through the App or other reasonable means, with an updated “Last Updated” date. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of [INSERT GOVERNING JURISDICTION, e.g., the State of ______, USA], without regard to conflict-of-law principles. [Insert dispute-resolution/arbitration clause here if desired — recommend attorney drafting for enforceability, especially if including an arbitration or class-action-waiver provision.]

17. Google Play Additional Terms

Because WildLens is distributed via Google Play, certain Google Play Terms of Service and policies (including Google Play’s refund and subscription-cancellation rules) apply in addition to these Terms, and in the event of a direct conflict regarding billing mechanics, Google Play’s applicable policies will govern the billing relationship between you and Google.

18. Severability and Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede any prior agreements.

This document is a general-purpose template and does not constitute legal advice. Given that WildLens processes payments/subscriptions and provides AI-generated health/safety guidance, we recommend having these Terms reviewed by a qualified attorney — particularly Sections 4 (billing), 11–12 (disclaimers/liability), and 16 (governing law/dispute resolution) — before publishing and before Google Play submission.
